Daniel joined our firm in 2018. He is currently studying his first LL.M. degree at the Universidad Andina Simón Bolívar in Quito, Ecuador. His main practice area is administrative litigation, now specializing in Intellectual Property litigation. He handles oppositions, litigation, copyright matters, examinations, and administrative complaints. - Diesel vs D4 Fit Wear - Oct, 2018
Diesel S.p.A. was able to assert its rights over their famous "D" design against a local manufacturer of clothing that intended to register a similar D4 design. Diesel S.p.A. filed an Andean opposition, based on their registration in Colombia which was first rejected by the Trademark Director. In Appeal, the IP Committee agreed on the likelihood of confusion and the prevalence of prior right in the Andean Community and rejected the application.
